The partner visa (subclass 820/801) is the onshore partner visa that lets you live in Australia with your partner, first on a temporary visa (820) and then on a permanent visa (801). You can apply if you are the spouse or de facto partner of an Australian citizen, Australian permanent resident, or eligible New Zealand citizen, and you are in Australia when you lodge your application.
There are two main partner visas, depending on where you are when you apply:
Subclass 820 and subclass 801 are applied for in one combined application. The 820 is temporary and the 801 is permanent. You receive the 820 first and may become eligible for the 801 once you meet all the requirements. The 801 grants permanent residency, with unrestricted work and study rights, travel access and Medicare benefits.
Onshore applicants typically become eligible for assessment for the subclass 801 visa two years after lodging their application.
Whether you are a de facto partner or legally married, a registered partner visa migration agent can help you understand the requirements and prepare your application.

To be eligible for the subclass 820/801 partner visa, you must meet these requirements under the Migration Act 1958:
Same-sex partners are also eligible to apply for this visa.
Understanding the partner visa requirements before you apply helps you prepare your application with confidence. Our registered migration agents can check whether you meet them and advise how to present your application for an Australian partner visa in your situation, whether you are married or in a de facto relationship.
The main benefit of the partner visa (subclass 820/801) is that it lets you build a life in Australia with your partner, with the opportunity to become a permanent resident.
While you hold the temporary 820 visa, you can work, study, travel and access Medicare as you wait for the permanent visa. The 801 then gives you permanent residency, which removes much of the uncertainty about your future in Australia.
With the subclass 820 visa, you can:
With the subclass 801 visa, you can:
The subclass 820/801 partner visa checklist covers identity documents, character documents and evidence that your relationship is genuine and continuing. The relationship evidence matters most, and it needs to be strong and consistent. Insufficient evidence is one of the key causes of partner visa refusals.
The evidence you need can vary depending on whether you are married or a de facto applicant. It is typically assessed against four main aspects of your relationship:
Australian Migration Agents (MARN 2217744) can advise which documents you need and help you prepare a complete checklist. This usually includes personal documents such as passports, birth certificates and national identity cards, alongside evidence for the four aspects above.

The subclass 820/801 partner visa has two stages: the temporary subclass 820 visa, then the permanent subclass 801 visa.
第 1 階段:臨時伴侶簽證(子類別 820)
To apply for the subclass 820 visa, you provide evidence that your relationship is genuine and continuing, along with personal and character documents. Once approved, the 820 visa lets you live, work, study and travel in Australia, and gives you access to Medicare. You generally hold it until you are eligible for the permanent subclass 801 visa.
第二階段:永久伴侶簽證(子類別 801)
Two years after you lodged your application, subclass 820 visa holders can be assessed for the subclass 801 visa, which requires updated evidence of an ongoing relationship.
子類 820 和 801 簽證的雙重授予
Some couples can be granted the 820 and 801 visas together, subject to meeting specific criteria. This is often the case where the couple has been together for three or more years, or two or more years if they have a child together.

Once the subclass 801 visa is granted, you are an Australian permanent resident. You can stay a permanent resident or, once you meet the residency requirements, apply for Australian citizenship.
As a permanent resident, your subclass 801 visa includes a 5-year travel facility for travelling in and out of Australia. If you become an Australian citizen, you also gain an Australian passport, consular assistance overseas and access to jobs that require citizenship.
Our registered migration agents (MARN 2217744) help you prepare and lodge a complete partner visa application and support you until the Department of Home Affairs makes a decision. The team at Australian Migration Agents has extensive combined experience with partner visa applications, including complex cases, and draws on its knowledge of the relevant legislation to guide you.

The cost of the subclass 820/801 partner visa has two parts: our professional fees for preparing your application, and the visa application charge payable to the Department of Home Affairs.
The visa application charge is the main government fee. It is subject to change, so check the current amount when you are ready to apply. The Department of Home Affairs Visa Pricing Estimator shows the exact charge for your circumstances.
Our professional fees depend on the complexity of your application and are quoted as a fixed fee, with flexible payment plans available. Book a consultation to receive a quote.

Partner visa processing times vary from case to case. The Department of Home Affairs publishes current processing times for the subclass 820 and 801 visas on its Global visa processing times page. Your timeframe depends on factors such as the complexity of your application, the quality of your evidence and the Department’s processing backlog.
You can help avoid delays by lodging a complete application with credible evidence, so the Department of Home Affairs has less need to ask for more information. If it does ask, respond promptly with relevant, concise information. Our registered migration agents (MARN 2217744) prepare ‘decision-ready’ applications, with all necessary documents attached from the outset.
You can generally apply for the partner visa 820/801 at any time if you are married or in a registered de facto relationship with an eligible partner. The right timing depends on your situation.
Whether to apply onshore or offshore also depends on your circumstances, and our registered migration agents can give you tailored advice. Consider the following:
De facto couples typically need to have lived together for at least 12 months, but exceptions exist:
To apply from outside Australia, see our page on the partner visa subclass 309/100. Book a consultation to confirm which option suits you.

If you hold a temporary partner visa (subclass 820/309), tell the Department of Home Affairs promptly, because your visa could be cancelled unless an exception applies. If you hold a permanent partner visa (subclass 801/100), you can keep living in Australia, because your right to stay does not depend on your relationship status and you do not need to notify the Department.
To notify the Department, complete the Notification of Relationship Cessation form in the ‘Update Details’ tab of your ImmiAccount, or submit a Change of Circumstances form (Form 1022) by email. Notify the Department straight away. If you do not, your visa could be cancelled without the chance to explain your circumstances. Once notified, the Department reviews your situation and decides whether you may still be eligible for a permanent visa.

After you notify the Department, you may still be able to stay in Australia in these circumstances:

If your relationship is no longer genuine and continuing and no exception applies, your visa may be cancelled. You may then need to apply for a new visa or plan to leave Australia.
If you believe a cancellation decision was incorrect, you can seek a review through the Administrative Review Tribunal (ART). A migration agent can guide you through this process.

If your partner visa is cancelled and no exception applies, you can consider applying for a different visa, such as a student, skilled, work or protection visa. When you apply, you may be granted a bridging visa that lets you stay in Australia until your new application is decided.
It depends on your circumstances. A partner visa is assessed on whether you meet all the requirements and can show strong evidence that your relationship is genuine and continuing. At a consultation, our registered migration agents assess your situation and give you a clearer idea of your prospects. Book a consultation to get started.
You can stay on the subclass 820 partner visa until your application for the permanent subclass 801 partner visa has been decided, as long as you continue to meet all visa conditions. The 820 is a temporary visa that lets you live and work in Australia in the meantime.
When you lodge your application, you are usually granted a Bridging Visa A, which you hold until your subclass 820 is decided. It lets you stay in Australia lawfully after your current visa expires. You can work, study and access Medicare on a Bridging Visa A. You can also apply for a Bridging Visa B, which allows you to travel in and out of Australia while your subclass 820 partner visa is processing.
You cannot control the Department’s processing time, but you can avoid delays by lodging a complete application with credible evidence and responding promptly to any request for more information.
Attach all relevant information and reliable evidence from the start, so the Department has fewer requests to make. If it asks for more, respond promptly with enough, but not excessive, information.
Our registered migration agents prepare ‘decision-ready’ applications, with all necessary documents attached from the outset.
